These Terms of Service ("Terms") govern your access to and use of kimberlybeekman.com and all programs, courses, and services offered by Maxwell Consulting Group LLC, doing business as Kimberly Beekman and Inner Alignment with Kim Beekman (collectively, "Company," "we," "us," or "our"), located at 7708 Corte Violeta, Carlsbad, CA 92009.
By accessing this website or purchasing any program or service, you ("Participant" or "you") agree to be bound by these Terms. If you do not agree, do not use this website or purchase any offering.
SECTION 1 — WHO WE ARE AND WHAT WE OFFER
Maxwell Consulting Group LLC operates under the DBAs Kimberly Beekman and Inner Alignment with Kim Beekman. We offer online wellness education programs including:

Inner Alignment Level 1, Level 2, and Level 3 Programs

Yoga Psychology Wellness Counselor (YPWC) 300-Hour YTT Certification Program

Other online programs and digital content as offered from time to time
All programs are educational and wellness-focused in nature. Nothing offered constitutes clinical therapy, medical treatment, or licensed mental health services.
SECTION 2 — ELIGIBILITY
You must be at least 18 years of age to purchase or participate in any program. By enrolling, you represent that you are of legal age and have the capacity to enter into a binding agreement. You also represent that there are no prior or pending government investigations or legal proceedings against you that would affect your participation.
SECTION 3 — ENROLLMENT AND PAYMENT
Payment must be received in full — or in accordance with your agreed payment plan — before access to program materials is granted.
Payment Plans: Where offered, payment plans require a first payment at enrollment and subsequent payments as specified at checkout (typically a second payment 8 weeks after enrollment). You are responsible for all scheduled payments regardless of your personal progress in the program. Failure to complete scheduled payments may result in loss of access to program materials and community.
All payments are processed securely through Stripe. All prices are listed in U.S. Dollars.
We reserve the right to modify program pricing at any time. Price changes will not affect enrollments already confirmed and paid.
SECTION 4 — REFUND POLICY AND PERFORMANCE GUARANTEE
All program fees are non-refundable except as explicitly outlined in the Performance Guarantee contained in your Participant Agreement, which is incorporated into these Terms by reference.
The Performance Guarantee applies solely to the YPWC 300-Hour Certification Program and requires full documented completion of all program requirements, including attendance, case studies, client engagements, and submission of qualifying client feedback surveys as defined in your Participant Agreement.
We do not guarantee income, client acquisition, or business results. Individual outcomes vary based on personal effort, commitment, and external market factors beyond our control.
Refund requests must be submitted in writing with complete documentation within 30 days of meeting the final qualifying conditions as described in your Participant Agreement. Requests submitted without complete documentation or outside this window will not be considered.
SECTION 5 — PROGRAM ACCESS AND COMPLETION
Upon enrollment, you will receive access to program materials as described in your Welcome email, which is incorporated into these Terms by reference. Program access timelines, completion requirements, and extension policies are governed by your Participant Agreement.
We reserve the right to modify, update, or discontinue program content at any time to improve quality and relevance. Material changes will be communicated to enrolled participants.
SECTION 6 — INTELLECTUAL PROPERTY
All content on this website and within our programs — including videos, audio files, written materials, slides, handouts, teachings, the Yoga Psychology™ methodology, and the Inner Alignment System — is the proprietary intellectual property of Maxwell Consulting Group LLC and is protected by U.S. and international copyright law.
Upon enrollment, you receive a limited, non-exclusive, non-transferable license to use program materials for your own personal and professional development. You may NOT:

Copy, reproduce, distribute, or resell any program materials

Teach, train, or certify others in the Inner Alignment methodology without explicit written authorization

Incorporate Inner Alignment curriculum into your own certification or training programs

Represent yourself as authorized to train others in this system
Only Kimberly Beekman and authorized Inner Alignment faculty may train and certify practitioners in this methodology.
SECTION 7 — USER CONDUCT
By using this website and participating in our programs, you agree to:

Provide truthful and accurate information at enrollment and in all communications

Maintain confidentiality of all participant and client information shared within program spaces

Engage with community members and staff with respect, integrity, and care

Refrain from harassment, discrimination, or harmful conduct toward other participants or staff

Comply with all applicable laws in your jurisdiction
We reserve the right to remove any participant from the program — without refund — for conduct that violates these standards or the integrity of the community.
SECTION 8 — HEALTH AND WELLNESS DISCLAIMER
Our programs involve yoga, breathwork, meditation, energy work, and somatic and psychological frameworks. These practices carry inherent physical and emotional risks. By enrolling, you represent that you are physically and mentally fit to participate, and you assume full responsibility for any risks, injury, or damages that may arise.
Nothing in our programs constitutes medical advice, clinical therapy, or psychiatric treatment. If you have a mental health condition, please consult a licensed clinical professional before enrolling and maintain outside therapeutic support throughout the program.
Our programs do not treat addiction, trauma, or mental illness. Graduates are certified as Wellness Counselors — not clinical therapists — and must represent themselves accurately in their marketing.
SECTION 9 — DISCLAIMER OF WARRANTIES
THE WEBSITE AND ALL PROGRAMS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO REPRESENTATIONS REGARDING THE ACCURACY OR COMPLETENESS OF ANY CONTENT ON THIS SITE.
SECTION 10 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, MAXWELL CONSULTING GROUP LLC, KIMBERLY BEEKMAN, INNER ALIGNMENT WITH KIM BEEKMAN, AND ALL TEAM MEMBERS, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THIS WEBSITE OR PARTICIPATION IN ANY PROGRAM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE PROGRAM.
SECTION 11 — TESTIMONIALS AND RESULTS DISCLAIMER
Testimonials shared on this website represent individual experiences and results. Your results will vary based on your effort, commitment, background, and other factors unique to you. We do not guarantee any specific outcome, income level, or business result from participation in our programs.
By submitting a testimonial or review, you grant Maxwell Consulting Group LLC a royalty-free, perpetual, worldwide license to use your name, likeness, and testimonial content in marketing and educational materials.
SECTION 12 — THIRD-PARTY LINKS
This website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any third-party site and do not endorse them. Your use of third-party sites is at your own risk.
SECTION 13 — TERMINATION
We reserve the right to terminate or suspend your access to the website or any program at any time, without notice, for conduct that violates these Terms, any applicable law, or the integrity of the program community. Upon termination, you remain responsible for any outstanding payment obligations. Sections 6, 9, 10, 14, and 15 survive termination.
SECTION 14 — GOVERNING LAW
These Terms are governed by the laws of the State of California without regard to its conflict of law principles. Any disputes not resolved informally shall be brought exclusively in the state or federal courts located in San Diego County, California. You consent to the personal jurisdiction of such courts.
SECTION 15 — CHANGES TO THESE TERMS
We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of this website following any changes constitutes your acceptance of the revised Terms.
